Unusual week

This has been an unusual week indeed.  I can't even remember Monday now but I believe Sunday was in the 50s.  On Tuesday, I did my driving job and it poured buckets of rain the whole day while I drove over 60 miles.  I drove an 84 plus lady with a debilitating disease home in which she mentioned that her church had been sending people to her home to visit that only asked her what she would do with her stuff when she died.  This happened 3-4 x in a row and she asked them to stop coming.  I am thinking of letting her pastor know since she has been a member 78 years.  It wasn't our church, that's for sure.  

On Wednesday, I was supposed to start a new job in education but we had our first snow day of the year and school was cancelled.  Mind you, it's March 16th and that being our first snow day of the year was more than strange.

I started my new job on Thursday, March 17th.  I forgot to wear green.  I was only worried about getting there on time and looking properly dressed.  I enjoyed the day thoroughly and loved every minute of it.

Today is Friday.  I survived the week.  I am on my lunch break and enjoy my job more and more.  Things have run smoothly and the students are nice.  

I have strongly limited watching air time on major news networks who fail to cover the presidential candidates equivalently.  I would say equally but there is no way that Kasich will get as much TV time as let's say, Trump.  CNN did something special last night.  They played an ad from a private citizen who produced a TV ad on why it was crazy to vote for Barry Goldwater in 1964.  He repudiated that there is no way he would vote for someone who was going to hijack the party and align with hate groups.   Here we are again 52 year later in the same boat.  Listen to the coverage of my radio show as we examine all the elements of executive decision making over the last 12 years.  We are in a cycle of American democracy that could produce a civil war.  If you want to hear more, tune into my radio page.  The link is on the Israeli flag on my blogger page, WHICH IS THIS PAGE.

Federal Intelligence Surveillance Act of 1978 and Modified Changes in 2001, 2005, 2007 and 2008

I did a radio show tonight on FISA and the history of it which was initiated in 1977.  The information is below.  It has been modified, and regulations loosened following 911 terrorist attacks in 2001.  This was partly due to the definition of a terrorist organization which had to be defined as "non-state actors"...those acting outside the traditional boundaries of the nation-state or identity with a particular nation.  Bush stretched the legal boundaries of the FISA act and now the Obama admin is under heat for doing the same due to leaks by Snowden and the fiasco last week of Verizon allowing the feds to review personal data of customer phone accounts.

The Foreign Intelligence Surveillance Act (FISA) was introduced on May 18, 1977, by Senator Ted Kennedy and was signed into law by President Carter in 1978. The bill was cosponsored by the nine Senators: Birch Bayh, James O. Eastland, Jake Garn, Walter Huddleston, Daniel Inouye, Charles Mathias, John L. McClellan, Gaylord Nelson, and Strom Thurmond.

The FISA resulted from extensive investigations by Senate Committees into the legality of domestic intelligence activities. These investigations were led separately by Sam Ervin and Frank Church in 1978 as a response to President Richard Nixon’s usage of federal resources to spy on political and activist groups, which violates the Fourth Amendment.^[4] The act was created to provide Judicial and congressional oversight of the government's covert surveillance activities of foreign entities and individuals in the United States, while maintaining the secrecy needed to protect national security. It allowed surveillance, without court order, within the United States for up to one year unless the "surveillance will acquire the contents of any communication to which a United States person is a party". If a United States person is involved, judicial authorization was required within 72 hoursafter surveillance begins.

Bush administration warrantless domestic wiretapping program

The Act came into public prominence in December 2005 following publication by the New York Times of an article^[5] that described a program of warrantless domestic wiretapping ordered by the Bush administration and carried out by the National Security Agency since 2002; a subsequent Bloomberg article^[6] suggested that this may have already begun by June 2000.

Scope and limits

For most purposes, including electronic surveillance and physical searches, "foreign powers" means a foreign government, any faction(s) or foreign governments not substantially composed of U.S. persons, and any entity directed or controlled by a foreign government. §§1801(a)(1)-(3) The definition also includes groups engaged in international terrorism and foreign political organizations. §§1801(a)(4) and (5). The sections of FISA authorizing electronic surveillance and physical searches without a court order specifically exclude their application to groups engaged in international terrorism. See §1802(a)(1) (referring specifically to §1801(a)(1), (2), and (3)).

The statute includes limits on how it may be applied to U.S. persons. A "U.S. person" includes citizens, lawfully admitted permanent resident aliens, and corporations incorporated in the United States.

The code defines "foreign intelligence information" to mean information necessary to protect the United States against actual or potential grave attack, sabotage or international terrorism.^[7]

In sum, a significant purpose of the electronic surveillance must be to obtain intelligence in the United States on foreign powers (such as enemy agents or spies) or individuals connected to international terrorist groups. To use Fisa, the goverment must show probable cause that the target of the surveillance is a foreign power or agent of a foreign power.  The Foreign Intelligence Surveillance Act established a court of 11 rotating federal judges living around D.C. area.  These judges are the same ones who rule on warrants the gov't seeks in domestic criminal cases.  If we trust them to rule in routine matters, would we not trust them with greater matters?

Awakenings

Maya Angelou's primetime chat with Piers Morgan was an inspiration in her choice of words and wisdom.  Among the Washington bickering, the race driven elite cannot see the cultural revolution of over 60 percent of the American population endorsing Barack Obama.  It is a God given occassion and mandate that a man with a foreign last name, mixed blood and Muslim parentage should be nobly elected to our greatest office.  I am humbled and honored in Barack's presence and as a citizen and endorser of his passion, intellect and drive to overcome the barriers of his oppressors to make this a greater nation still.  He will not wane in discouragement but he will journey on into persistence the mark of his administrative goals while managing a nation in constant distress and division.  Unity is the desire but moral virtue is the impetus to change and bringing together many under common causes.  I pledge my support to Barack Obama.

America’s Fallen State

When I voted for Obama, I did it with tears, not a political scorecard. He wasn’t even my first choice. Hillary Rodham Clinton, in all her intellectual cadence, could not pull it off. Three years later, I am very self-aware that hope could ever be manifested into concrete terms, suffice to say, I may now get free health care that I have to pay for vs. the free version I get due to poverty. Since Schwarzenegger, cut out my vision and dental care, I am somewhat relieved that if I go blind or my teeth fall out, no one can blame me for double dipping, but my son will have the good sense to carry on.

For me, a transitional mother at age 50 with a Master’s in Political Science and an income of $10,000 a year is a paradoxical grip on my limited horizontal vision for America. In my socialist diatribe, I don’t fully believe I deserve to earn more than 30k a year and I feel guilty for still depending on medical and low income housing. However, I sacrificed food stamps and cash aid for the higher good because I swallowed the mantra of Larry Elder of KABC that I was a “victocrat” on all levels. The airwaves demonstrated to me a sense of national purpose that manifested itself beyond my economic condition to make a Jeremy Bentham greatest good sacrifice for the greatest number.

Finding my way into shiny shoes of success would take more than a polished resume and glad handling handshakes at this point. I haven’t beaten my butt down the corridor of endless job search in America. I’ve been hiding at the University getting a teaching credential, my third degree. Why? I don’t lack compassion for hard work. I often spend 12 hours days between my menial teacher assistant position at an adult school, student teaching and driving my son home between shifts. I am one of the growing numbers of Americans, I suspect, who fear success from a money standpoint and believe that success is money ordained. That puts me in the category of socialist impaired, because redistribution is something I believe in.

On a grander scale, I don’t blame Obama or look for a new charlatan to resurrect me or my son’s future to a greater America. I fully believe the system cannot and has not worked and the only cohesive branch of government is the justice branch that can still pull presidential election coups and landscape social ideology. I coincide with reality of the post-modern cynicism that American entities of economic structure and government application are mismanaged, corrupt and ineffective. Corporate America does farm out jobs overseas, steals common people’s investment money and few companies have American people’s future in their best interest.

I grew up privileged and subconsciously became poor. When my daughter died under private health care from a failed heart transplant on Christmas Day 1992, I did not scrutinize the public vs. private debate of better health care. I was married and somewhat secure. Today, I scrutinize the system as a whole, because I see chiseling being done on all levels of public service. When I drive down the street, I see welfare mothers walking to the Public Social Services building and know I am inherently better off than them. Pretty soon, I will have a credential where I can reinforce theoretical commonalities of American society into high school students’ minds. I know the clash of civilizations projected by Samuel Huntington is as real as his similar theory as searching for a strong American identity with no loyalty to the state. I’m loyal but my heart is disloyal because within structure I have stopped believing. That’s why I am taking the Math subtests for teaching, because California has a seriously declining capacity to hire new teachers, all the state budgets are maxed out and each party blames the demanding constituent needs on the individual electorate.

I will be one of those people who will be happy going back to a day care job at $10.00 an hour because belief in wealth has been co-opted by the greedy, self-pontificating and grafted into a system of winner wants all and blame everyone. Four more years will not eradicate federal and state problems, but I‘d like to think someone like Ron Paul, an outside the box thinker could make it right but outsourcing the hidden puppet masters. Would it take one person to change it all? Or only me, by getting a 50k plus job, then paying taxes only to be publicly notified that my contribution falls short of ultimate expectations.
